1. Scope

These Terms govern all orders placed by consumers (§ 13 BGB) through our online shop. Deviating terms do not apply unless we agree in writing.

2. Offers & Contract Conclusion

Product listings are invitations to order, not binding offers. By clicking “Buy/Pay now,” you submit a binding order. The contract is formed when we confirm by email or dispatch the goods.

3. Prices, VAT & Shipping Costs

We operate as a small business under § 19 UStG (Kleinunternehmer). Prices are final; no VAT is shown or charged. Shipping costs and any free-shipping thresholds are displayed during checkout. For deliveries outside the EU, the buyer is responsible for any customs duties, taxes, or fees.

4. Payment

Payment methods are shown at checkout. We dispatch in-stock items after receipt of payment. For pre-orders, we may capture payment when you place the order.

5. Delivery & Availability

  • In-stock items (postcards, zines): dispatch usually within 3–5 business days.

  • Pre-order shirts (hand/screen-printed): produced after the pre-order window closes; estimated dispatch 2–3 weeks after production starts (see product page for current estimate).

    Delivery times may vary by destination and carrier. If an item becomes unavailable after your order, we will notify you and refund without delay.

6. Pre-Orders & Handmade Variations

Pre-order shirts are produced in small batches. Minor variations in color/print placement are inherent to hand printing and do not constitute defects.

7. Right of Withdrawal (Returns)

Consumers have a 14-day withdrawal right for in-stock items (see our separate Returns & Refunds / Withdrawal Policypage for full details and instructions).

Exception: The withdrawal right does not apply to made-to-order goods that are produced to customer specifications—this includes our pre-order shirts (legal basis: § 312g(2) no. 1 BGB).

8. Retention of Title

Goods remain our property until paid in full.

9. Warranty (Gewährleistung)

Statutory warranty rules apply. If a product is defective, please contact us at info.snailmailsociety@gmail.com with order details and photos where helpful.

10. Liability

We are liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. For slight negligence, we are liable only for breach of essential contractual duties (cardinal obligations), limited to the foreseeable damage typical for the contract. Liability under the Product Liability Act remains unaffected.

11. Customer Accounts, Communication

You are responsible for keeping your account data confidential and for ensuring emails from us can reach you (check spam folders, etc.).

12. Data Protection

Personal data are processed as described in our Privacy Policy available on the website.

13. Online Dispute Resolution; Consumer ADR

The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Governing Law & Contract Language

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in the EU, mandatory consumer protection provisions of your country of residence remain unaffected. Contract language is English (translations may be provided for convenience).

15. Final Provisions

If any provision is or becomes invalid, the remaining provisions remain in effect. We may update these Terms for future orders; the version displayed at the time of your order applies.

    Geltungsbereich & Vertragssprache

    Diese AGB gelten für alle Bestellungen über www.snailmailsociety.de. Vertragssprache ist Deutsch. Etwaige Übersetzungen dienen nur der Verständlichkeit; maßgeblich ist die deutsche Fassung.

    1. Vertragspartner, Vertragsschluss

    Die Produktdarstellungen sind kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe einer Bestellung. Mit Klick auf „Kaufen/Bezahlen“ geben Sie ein verbindliches Angebot ab. Der Vertrag kommt durch unsere E-Mail-Bestätigung oder Versand der Ware zustande.

    2. Preise, Umsatzsteuer, Versandkosten

    Wir handeln als Kleinunternehmer nach § 19 UStG (keine Ausweisung/Erhebung von Umsatzsteuer). Zzgl. anfallender Versandkosten, angezeigt im Checkout. Etwaige Zölle/Abgaben außerhalb der EU trägt der Kunde.

    3. Zahlung

    Zahlungsarten gemäß Anzeige im Checkout. Versand/Lieferung erfolgt nach Zahlungseingang. Bei Pre-Orders kann die Zahlung bei Bestellung fällig werden.

    4. Lieferung & Verfügbarkeit

    • Lagerware (Postkarten, Zines): Versand i. d. R. innerhalb von 3–5 Werktagen.

    • Pre-Order Shirts (hand/siebdruck): Produktion nach Ende des Vorbestellungszeitraums; voraussichtlicher Versand 2–3 Wochen nach Produktionsstart (konkrete Angabe auf der Produktseite).

      Lieferzeiten können je nach Ziel und Dienstleister variieren. Wird ein Artikel nach Bestellung dauerhaft nicht verfügbar, erstatten wir unverzüglich.

    2. 5. Pre-Order & Handarbeit

    Pre-Order-Shirts werden in Kleinserien handbedruckt. Geringe Abweichungen in Farbe/Position sind herstellungsbedingt und stellen keinen Mangel dar.

    6. Widerruf & Rücksendung

    Für Lagerware besteht ein 14-tägiges Widerrufsrecht (Details in der Widerrufsbelehrung auf der Website).

    Ausgeschlossen vom Widerruf sind Sonderanfertigungen/auf Bestellung gefertigte Waren im Sinne von § 312g Abs. 2 Nr. 1 BGB — hierzu zählen unsere Pre-Order-Shirts.

    7. Eigentumsvorbehalt

    Bis zur vollständigen Zahlung bleibt die Ware unser Eigentum.

    8. Gewährleistung

    Es gilt das gesetzliche Mängelhaftungsrecht.

    9. Haftung

    Unbeschränkte Haftung bei Vorsatz, grober Fahrlässigkeit sowie für Schäden aus Verletzung von Leben, Körper oder Gesundheit. Bei einfacher Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), beschränkt auf den vertragstypisch vorhersehbaren Schaden. Produkthaftung bleibt unberührt.

    10. Datenschutz

    Personenbezogene Daten verarbeiten wir gemäß unserer Datenschutzerklärung auf der Website.

    11. Online-Streitbeilegung & Verbraucherschlichtung

    Plattform der EU-Kommission: https://ec.europa.eu/consumers/odr/.

    Wir sind weder verpflichtet noch bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

    12. Schlussbestimmungen

    Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Zwingende Verbraucherschutzvorschriften des EU-Wohnsitzstaates bleiben unberührt. Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen unberührt.
